Red-Bull-Statement

So kann es manchmal gehen! Da will man gerade Feierabend machen, dann kommt doch noch etwas dazwischen. Red Bull hat gerade doch noch ein Statement veröffentlicht, in dem es heißt, man nehme die Entscheidung "mit Überraschung und Enttäuschung" zur Kenntnis.

"Unsere Einreichung für 2021 lag unter dem Kostendeckel", betont man. Daher müsse man jetzt analysieren, warum die FIA das anders sehe. Man bleibe aber bei seiner Meinung, dass man die Budgetobergrenze nicht gebrochen habe.

Viele Fragen bleiben offen

Ihr seht schon: Die Entscheidung der FIA ist zwar endlich da. Aber gefühlt gibt es dadurch fast mehr Fragen als vorher ... Wir müssen also weiter abwarten, wie es jetzt in Sachen Strafen und Co. weitergeht.

Hier im Ticker ist für heute auf jeden Fall erst einmal Feierabend. An den nächsten beiden Tagen übernimmt mein Kollege Norman Fischer an dieser Stelle, wir lesen uns dann am Donnerstag wieder.

Noch keine Stellungnahmen

Natürlich würden wir jetzt auch gerne hören, was die betroffenen Teams selbst zur FIA-Entscheidung sagen. Leider gibt es weder von Red Bull noch Aston Martin zum jetzigen Zeitpunkt ein Statement.

Die Bullen haben zuvor ja immer klargestellt, dass sie fest davon ausgehen, unter dem Kostendeckel geblieben zu sein. Diese Einschätzung war ganz offensichtlich falsch.

Wie viel hat Red Bull ausgegeben?

Auch diese Frage bleibt unbeantwortet. Da es sich allerdings um ein kleineres Vergehen handelt, muss die Summe unter fünf Prozent der Budgetobergrenze liegen, maximal bei rund sieben Millionen US-Dollar also.

Aber die anderen Teams haben in den vergangenen Wochen ja bereits erklärt, dass man sich selbst mit dieser Summe einen gewaltigen Vorteil verschaffen könnte, auch wenn es auf dem Papier nur ein "kleiner" Verstoß ist.

Allerdings: Weil die FIA die Summe offen lässt, kann es sich genauso gut um lediglich 100 oder 1.000 Dollar handeln. Ist also alles reine Spekulation.

"Procedural Breach"

Worum genau geht es dabei? Die Möglichkeiten sind vielfältig. Es kann zum Beispiel eine zu späte Einreichung sein, eine fehlende Antwort auf eine Anfrage, eine lückenhafte Einreichung oder solche Dinge eben.

In Artikel 8.2 der Finanzregeln der Formel 1 heißt es:

Examples of Procedural Breaches include:

(a) making a Late Submission;

(b) failing to submit Interim Reporting Documentation by the Interim Reporting Deadline;

(c) failing to cooperate with or respond to a written request for information, documentation or clarification from the Cost Cap Administration within the timeframe imposed by the Cost Cap Administration;

(d) delaying, impeding or frustrating the exercise by the Cost Cap Administration of its regulatory function, including an investigation conducted under the Financial Regulations, or any attempt to do so;

(e) submitting Reporting Documentation that is inaccurate, incomplete or misleading;

(f) failing to comply with the terms of an ABA;

(g) failing to comply with the requirements of Articles 1.8, 1.9 or 1.10;

(h) failing to submit information or documentation required by any Determination by the applicable deadline included in that Determination; or

(i) failing to submit a Used Inventory Incremental List in accordance with the requirements set out within FIA technical directive TD017 as renumbered and/or amended from time to time.

Das FIA-Statement im Wortlaut

FIA completes review under the 2021 FIA Formula 1 Financial Regulations

- Nine teams confirmed under the 2021 Cost Cap Level
- Aston Martin in Procedural Breach
- Red Bull Racing in Procedural and Minor Overspend Breaches

The FIA confirms that its Cost Cap Administration has now completed the review of the Reporting Documentation submitted by each Competitor that participated in the 2021 FIA Formula One World Championship in respect of the 2021 Reporting Period ending on 31 December 2021.

The FIA Cost Cap Administration has issued certificates of compliance to seven of the ten Competitors:

- Aston Martin Aramco Cognizant Formula One Team is considered to be in Procedural Breach of the Financial Regulations;
- Oracle Red Bull Racing is considered to be in Procedural and Minor Overspend Breaches of the Financial Regulations; and
- Williams Racing has complied with the Financial Regulations in respect of the 2021 Reporting Period with the exception of a previous Procedural Breach (in regard to which the Cost Cap Administration entered into an ABA with Williams in May 2022. This Procedural Breach was then remediated by Williams in a timely, cooperative and transparent manner).

The review of the Reporting Documentation submitted has been an intensive and thorough process, and all Competitors gave their full support in providing the required information to assess their financial situation during this first year of the Financial Regulations. The FIA Cost Cap Administration notes that all Competitors acted at all times in a spirit of good faith and cooperation throughout the process.

The FIA would also note that with respect to this first year of the application of the Financial Regulations the intervention of the FIA Cost Cap Administration has been limited to reviewing the submissions made by the Competitors and that no full formal investigations were launched.

The FIA Cost Cap Administration is currently determining the appropriate course of action to be taken under the Financial Regulations with respect to Aston Martin and Red Bull and further information will be communicated in compliance with the Regulations.

Welche Strafen wären möglich?

Den "Procedural Breach" kann man vermutlich vernachlässigen, dieser wird wohl wie bei Williams lediglich eine Geldstrafe nach sich ziehen. Wäre zumindest meine Vermutung.

Anders sieht es bei der Überschreitung durch Red Bull aus. Da geht die Möglichkeit von einer Verwarnung bis hin zu Abzügen von WM-Punkten für Team und Fahrer.

Aber: Ein kompletter Ausschluss aus der Meisterschaft ist nicht möglich, weil es sich lediglich um ein kleineres Vergehen handelt.

Welche Strafe droht Red Bull und Aston Martin?

Das ist aktuell noch offen. Wörtlich heißt es von der FIA:

"The FIA Cost Cap Administration is currently determining the appropriate course of action to be taken under the Financial Regulations with respect to Aston Martin and Red Bull and further information will be communicated in compliance with the Regulations."

Heißt: Man wird jetzt über ein angemessenes Strafmaß entscheiden und dieses zu gegebener Zeit bekanntgeben. Das dürfte aber noch etwas dauern.
